Moreover, there is a need to develop a framework within which Ã¢â¬Å"alcohol-related pathologyÃ¢â¬ could be accounted for in the adolescent stage of a personÃ¢â¬â¢s life (Society for the Study of Addiction, 2004). The article likewise cites Liddle (2004), who reviewed therapies involving the family of the adolescent who has problems in alcohol and drug abuse. However it was the case, other set up cost and deposited and fixed charges of $30 were there and hence the advertisement was in false and misleading nature resulting in contravention of Section 53.The Set up FeeThe judge concluded that generally set fee for broadband changed for contract less than 24 month, however the new consumer was not sufficiently provided information for this set up fees. The judge found from investigation that none of the targeted was aware about the set up fees attached with the offer and hence the TPG was unable to disclose the fair and full information to targeted consumer. Single PriceThe total cost of the service was more than $29.99 which was disclosed prominently as a single price. The other cost like set up cost of $20, Usage charge of landline service of $ 30 and $20 deposited and others. The total price of $ 509.89 for service was not disclosed clearly as single price.4. It is to be noted that the difference of an opinion between Full court and the primary court was of difference in approach of interpreting principals. The Full court had taken view that the targeted audience was not mislead because the past data shows people were not more interested in landline service and hence targeted audience were in state of non-interest, Further the full court had held that the Prominent message which was one of the criteria to give judgment against AGP, should be construed in the terms of misleading, the term dominate message cannot overrule the fact that the whole advertisement should be read carefully. The Full court said that the strict provision of thi s act cannot extend where person is not able to take care reasonably to read the advertisement by applying case of Miller Associates Insurance Broking Pty Ltd v BMW Australia Finance Ltd.5. The High court held that full courts is failed to consider the term Prominent Message , as the case of Miller Associates Insurance Broking Pty Ltd v BMW Australia Finance Ltd was opt applicable in existing case because of non existence of decisive factor. Also High court said the fact that the targeted peoples knowledge regarding bundled service in this industry does not affect the misleading nature of the advertisement. The full court had taken the knowledge of targeted consumer regarding offering of bundled service but the high court had declined the content and base of the Full court.6. Following are the three main reason based on which High court said the applied case of Puxu was not proper in TPG advertisement.(1) It is to be noted that the position of the targeted audience in both case we re different , in case of Puxu the audience visiting the showroom , had substantial mind and intention of purchase of the product . However this was not case in TPG, the targeted audience in same case was in general just to draw the attention of the Customer and making them interested in product. The fact of the both case of was different(2) Also as per high court explanation the full court had failed to recognize the fact that the main purpose of the advertisement was to drag consumers in negotiation with TGP against the competitor by showing misleading message or advertisement prominently. However in the case of Puxu , the main intention was to induce customer only to enter into contract only(3) The fact that the consumer should take reasonable care before entering into contracts cannot be interpreted as protection when the whole intention of the advertisement was to mislead the consumer or showing erroneous message. Here the High court found that in case of Puxu it was not the ca se. Here the advertisement was taken as medium to draw the attention of the consumer by misleading message which cannot be protected by the fact that they should take care reasonably.7. The high court had said that the Dominant message interpreted by the primary court was reasonable as the Full court had wrongly applied the case of Puxu. It is to be noted that the fact of taking reasonable care by customer cannot be used as protection when the Prominent message apparently misleading the consumers. The full court given the Judgment based on argument that it was responsibility of the customer to check full advertisement carefully and then relying on this, and same had been pronounced by applying Puxu case. But High court had taken a view that the Prominent message is given by Company was found to attract new customer for bargaining with customer in oppose to customer, which shows clear intention to draw wrong attention of the customer by not disclosing all the information apparently d ominantly. 8. The high court had said that the fact that the advertise was misleading could not be ignored with assumption of full court that consumer who was reading the advertisement had knowledge of bundled pricing of the product. The Full court had taken a view that the targeted audience must ne know to the nature of advertisement prevailing in this industry , like bundle pricing in Internet service provider are common now and hence it could not be concluded advertisement is misleading. But high court had overruled Full courts view of this Audience Knowledges theory application and pronounced Once the advertisement was in nature of misleading, same was said to be contravene the provision of Section 53 of the relevant Act9. The court thought it said that the way in which advertisement was published by TPG could not be said that it had produce all the element of offer fairly. The court said that though the direct intention of the TGP was not to mislead the consumer but as the intention to emp hasize of most favorable offer was there. Native American Astronomy For many years astronomers and people alike have constantly heard about the observations and records of the Chinese and Europeans. No other culture can provide as much information as that gathered by the Chinese and Europeans, but there are many other cultures that observed and recorded the night sky, one of those being the Native Americans. During the last fifteen to twenty years archaeoastronomers have uncovered much concerning the beliefs and records of Native Americans. Unfortunately, the methods of keeping records of astronomical events were not as straight forward as the Chinese and Europeans. The Native Americans had to use what they could to record what they observed. Their records were found on rock and cave drawings, stick notching, beadwork, pictures on animal skins and story telling. In 1984 Von Del Chamberlain listed the astronomical references for 50 Sioux, forty five out of fifty referred to an intense meteor shower during 1833/1834. He also listed nineteen winter counts kept by other plains Indian tribes, fourteen of which referred to the Leonid storm. The Leonids also appear among the Maricopa, who used calendar sticks with notches to represent the passage of a year, with the owner of the stick remembering the events. The owner of one stick claimed records had been kept that way since the stars fell. The first notch on the stick represented 1833. A member of the Papago, named Kutox, was born around 1847 or 1848. He claimed that 14 years prior to his birth the stars rained all over the sky. A less obvious Leonid reference was found in a journal kept by Alexander M. Stephen , which detailed his visit with the Hopi Indians and mentions a talk he had With Old Djasjini on December 11, 1892. That Hopi Indian said, How old am I? Fifty, maybe a hundred years, I cannot tell. When I was a young boy eight or ten years there was a great comet in the sky and at night all the above was full of shooting stars. (Stephen 37). During the lifetime of Old Djasini there was never a great comet and a sky full of meteors in the same year, but he might be referring to the comet in 1843 and the Leonid storm in 1833. The Pawnee have a story about a person named Pahokatawa, who was killed by an enemy and eaten by animals, and then brought back to life by the Gods. The legend goes that he fell to earth as a meteor and told the people that when meteors were seen falling in great numbers it was not a sign that the world would end. When the pawnee tribe witnessed the time the stars fell upon the earth, which was in 1833, there was a panic, but the leader said, remember the words o f Pahokatawa and the people were no longer afraid. This shows how powerful a role astronomy played in the Native American culture. Although the Pawnee learned not to be afraid there were Native Americans who feared meteors. The Blackfeet of Montana believed a meteor was a sign that sickness would come to the tribe in the winter the Kawaiisu thought a meteor started high and fell to the horizon was an omen of death. The Cahuilla thought a meteor was the spirit of their first shaman, takwich, who was disliked his people. Takwich wandered the sky at night looking for people far from their tribe. If he found a lost person he steal their spirit and the person home and eat them. The Shawnee believed meteors were beings fleeing from the wrath of some adversary, or from some anticipated danger.(Howard 178) Many Native Americans saw the stars as heavenly and mystical. A Review of James Joyce's Novel 'Ulysses' Ulysses byÃ James Joyce holds a very special place in the history of English literature. The novel is one of the greatest masterpieces of modernist literature. But, Ulysses is also sometimes seen as so experimental that it is completely unreadable. Ulysses records events in the lives of two central charactersLeopold Bloom and Stephen Dedaluson a single day in Dublin. With its depth and complexities, Ulysses completely changed our understanding of literature and language. is endlessly inventive, and labyrinthine in its construction. The novel is both a mythical adventure of the every day and a stunning portrait of internal psychological processesrendered through high art. Brilliant and sparkling, the novel is difficult to read but offers rewards tenfold the effort and attention that willing readers give it. Overview The novel is as difficult to summarize as it is difficult to read, but it has a remarkably simple story. Ulysses follows one day in Dublin in 1904tracing the paths of two characters: a middle-aged Jewish man by the name of Leopold Bloom and a young intellectual, Stephen Daedalus. Bloom goes through his day with the full awareness that his wife, Molly, is probably receiving her lover at their home (as part of an ongoing affair). He buys some liver, attends a funeral and, watches a young girl on a beach.Daedalus passes from a newspaper office, expounds a theory of Shakespeares Hamlet in a public library and visits a maternity wardwhere his journey becomes intertwined with Blooms, as he invites Bloom to go along with some of his companions on a drunken spree. They end up at a notorious brothel, where Daedalus suddenly becomes angry because he believes the ghost of his mother is visiting him. He uses his cane to knock out a light and gets into a fightonly to be knocked out himself. Bloom revives him and takes him back to his house, where they sit and talk, drinking coffee into the wee hours. In the final chapter, Bloom slips back into bed with his wife, Molly. We get a final monologue from her point of view. The string of words is famous, as it is entirely devoid of any punctuation. The words just flow as one long, full thought. Telling the Story Of course, the summary doesnt tell you a whole lot about what the book is really all about. The greatest strength of Ulysses is the manner in which it is told. Joyces startling stream-of-consciousness offers a unique perspective on the events of the day; we see the occurrences from the interior perspective of Bloom, Daedalus, and Molly. But Joyce also expands upon the concept of stream of consciousness.His work is an experiment, where he widely and wildly plays with narrative techniques. Some chapters concentrate on a phonic representation of its events; some are mock-historical; one chapter is told in epigrammatic form; another is laid out like a drama. In these flights of style, Joyce directs the story from numerous linguistic as well as psychological points of view.With his revolutionary style, Joyce shakes the foundations of literary realism. After all, arent there a multiplicity of ways to tell a story? Which way is the right way? Can we fix on any one truthful way to approach t he world? The Structure The literary experimentation is also wedded to a formal structure that is consciously linked to the mythical journey recounted in Homers Odyssey (Ulysses is the Roman name of that poems central character). The journey of the day is given a mythical resonance, as Joyce mapped the events of the novel to episodes that occur in the Odyssey.Ulysses is often published with a table of parallels between the novel and the classical poem; and, the scheme also offers insight into Joyces experimental use of the literary form, as well as some understanding of how much planning and concentration went into the construction of Ulysses.Intoxicating, powerful, often incredibly disconcerting,Ã Ulysses is probably the zenith of modernisms experimentation with what can be created through language. Cherokee removal - Essay Example The removal has been regarded as a tragic incident in the history of Cherokee nation. They called it Nu Na da ul Tsum yi in their own language that mans a place where they cried. In psychology way, are also needs to pay more time to recovery and step by step to build up their working feeling to improve the productivity. To reduced the number of occupational accident and injury in warehouse and workplace. Need to evaluate and analyses more detail before setup the workplace. So that why we need to depend on Occupational safety and health management systems. To determine the major cause of occupational accident in warehouse. 1.4 METHODOLOGY To satisfy the objectives, this report can divide into two parts. The first part is collect major data from our warehouse. The second part is using the result to improve the safety and health management for warehouse. In the first part, we step by step to collect and research some data from the working location. We need to record the working behavior and observe their working process to analyze their working sequence. And then base on their working process to find out which working process will cause occupational accident. That following data I will collect from my part time job location in the garment warehouse. And I will develop the safety and management system to help for this warehouse to reduce number of accident. This following data for case study will show into next part, such as causes of accident, working environment. For these case studies, warehouse supervisors and staffs are interview from survey Questionnaire. From this questionnaire will list number of possible cause can lead the occupational accident. It reminds that no any system can fully to prevent all the risk from safety system, no matter what the system is really outstanding can manage external condition and worker actions are also cannot perfectly to reduce all accident in warehouse. On the other hand, if insert too many of safety characteristic into safety system may be affect the original goal for the warehouse. The level of safety function is needed to concede based on the level of accident. The potential hazard caused by the people, tools and equipment and working condition are mixed together to make a possible to occur.
